Terms of Service

1. Acceptance of Terms

By accessing or using Appziot’s mobile app builder service and related products (collectively, the “Service”), you accept and agree to be bound by these Terms of Service. If you do not agree, do not use the Service. If you use the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Description of Service

Appziot provides a platform that enables Shopify merchants to design, configure, publish, and manage mobile applications for iOS and Android. The Service includes app building tools, Shopify data synchronization, push notifications, hosting-related features, analytics, and ongoing maintenance capabilities made available through our Shopify app and admin dashboard.

3. User Accounts

To use the Service, you must:

  • Be at least 18 years old or have valid parental or guardian consent
  • Provide accurate and complete registration information
  • Maintain the security of your Shopify and Appziot account credentials
  • Notify us promptly of any unauthorized access
  • Be responsible for all activities conducted under your account

4. Subscription, Billing, and Usage-Based Charges

Appziot is billed as a Shopify app. All subscription and usage charges are processed through Shopify App Pricing and the Shopify Billing API. Charges appear on your Shopify bill; Appziot does not maintain a separate payment method or invoice for app subscriptions.

4.1 Recurring Subscription Plans

Paid plans are offered on a recurring basis (monthly or annual, as selected). Current plan names, features, and list prices are shown on our pricing page and within the Appziot billing section of your Shopify admin. By approving a subscription in Shopify, you authorize recurring charges at the then-current rate for your selected plan and billing interval.

4.2 Free Trial

Eligible merchants may receive a free trial when activating their first paid plan through Shopify. Trial eligibility, duration, and start date are determined at subscription time. After the trial ends, recurring charges apply unless you cancel before the trial period expires.

4.3 Usage-Based Charges

Certain plans may include optional usage-based charges for approved customizations, premium design work, or other billable services beyond your plan’s included allowance (“Usage Charges”). Where applicable:

  • Usage Charges are billed through Shopify’s usage billing line on your app subscription
  • A monthly capped amount (“Usage Cap”) limits the maximum Usage Charges that can be applied in a billing period
  • Usage Charge terms, including the cap amount and what activities may be billed, are disclosed when you approve or change your subscription in Shopify
  • Usage Charges are applied only for services you request or approve; Appziot does not automatically charge for undisclosed usage
  • Annual subscriptions may track customization allowances in-app; Shopify usage billing lines apply to monthly subscriptions only, per Shopify platform rules

Push notification subscriber counts and plan allowances are informational for plan limits. Push notifications are not billed as separate per-subscriber usage charges unless explicitly stated in your plan terms at the time of purchase.

4.4 Plan Changes, Coupons, and Taxes

  • You may upgrade or downgrade plans through the Appziot billing interface; changes take effect after you approve them in Shopify
  • Promotional coupons or campaigns may reduce recurring charges when valid and applied before subscription approval
  • Prices are subject to change with reasonable advance notice; continued use after a price change constitutes acceptance where permitted by law
  • Applicable taxes, duties, or government charges may be added as required by Shopify or local law

4.5 No Commission on Orders

Appziot does not charge a sales-channel commission on orders placed through your mobile app or Appziot checkout. Standard Shopify payment processing and transaction fees still apply.

4.6 Cancellation and Refunds

You may cancel your subscription through Shopify or by uninstalling the Appziot app. Upon cancellation, access generally continues until the end of the current billing period. Refunds, if any, are handled in accordance with Shopify’s billing policies and applicable law. Usage Charges already incurred for approved services are non-refundable except where required by law.

5. Intellectual Property Rights

You retain all rights to your store content, branding, and materials. By using the Service, you grant Appziot a limited license to use your content solely to provide, operate, and improve the Service.

Appziot retains all rights to the platform, software, documentation, and related technology. You may not copy, reverse engineer, or create derivative works of the Service except as expressly permitted by law or a separate written agreement.

6. Acceptable Use Policy

You agree not to:

  • Use the Service for any unlawful purpose
  • Violate Shopify’s Partner Program Agreement, Acceptable Use Policy, or applicable API terms
  • Infringe intellectual property or privacy rights of others
  • Upload malicious code, malware, or harmful content
  • Attempt unauthorized access to Appziot, Shopify, or third-party systems
  • Interfere with other users’ use of the Service
  • Engage in fraudulent, deceptive, or misleading practices
  • Circumscribe Shopify checkout, billing, or core commerce workflows

7. Mobile App Publishing and Developer Accounts

Appziot provides tools to build and manage mobile applications for iOS and Android. To publish your app to the Apple App Store or Google Play Store, you must maintain active developer accounts with Apple and Google, respectively.

7.1 Developer Account Requirements

You are responsible for obtaining and maintaining:

These accounts must be registered in your name or your business entity’s name. Appziot cannot create, transfer, or assume liability for your developer accounts.

7.2 App Store Submission Process

Appziot assists with app build generation and provides guidance on submission requirements. However:

  • You remain responsible for submitting your app through your developer console
  • You must ensure your app content, branding, and functionality comply with all platform policies
  • You are responsible for responding to app review feedback and making necessary changes
  • Appziot provides technical support for build-related issues but does not control or guarantee approval decisions made by Apple or Google

7.3 Ongoing Compliance

App Store and Google Play policies change over time. You agree to:

  • Monitor platform policy updates and ensure continued compliance
  • Maintain active developer account memberships and renew annual fees as required
  • Update your app promptly if notified of policy violations or technical requirements
  • Accept that apps may be removed or suspended by Apple or Google for policy violations beyond Appziot’s control

7.4 No Guarantee of Approval

Appziot does not guarantee that your app will be approved for initial listing or ongoing distribution on the Apple App Store or Google Play Store. App review decisions are made solely by Apple and Google based on their independent review processes and policies.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted access. Maintenance, updates, third-party outages, or force majeure events may temporarily affect the Service. We may modify features with reasonable notice where practicable.

9. Termination

We may suspend or terminate access if you violate these Terms, fail to pay applicable charges, or if continued provision of the Service poses legal or security risk. You may stop using the Service at any time by cancelling your subscription and uninstalling the app.

10. Limitation of Liability

To the maximum extent permitted by law, Appziot shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for claims relating to the Service shall not exceed the amount you paid Appziot through Shopify in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold Appziot harmless from claims, damages, losses, and expenses arising from your use of the Service, your store content, your mobile app, or your violation of these Terms or applicable law.

12. Privacy

Our collection and use of personal data is described in our Privacy Policy, GDPR Compliance, and Data Security pages, which are incorporated into these Terms by reference.

13. Modifications to Terms

We may update these Terms from time to time. Material changes will be posted on this page with a revised “Last updated” date. Continued use after changes become effective constitutes acceptance where permitted by law.

14. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Disputes shall be subject to the exclusive jurisdiction of courts located in India, unless mandatory local law provides otherwise.
